In this paper, we provide a new framework for understanding infant-feeding-related maternal guilt and shame, placing these in the context of feminist theoretical and psychological accounts of the emotions of self-assessment. Whereas breastfeeding advocacy has been critiqued for its perceived role in inducing maternal guilt, we argue that the emotion women often feel surrounding infant feeding may be better conceptualized as shame in its tendency to involve a negative self-assessment—a failure to achieve an idealized notion of good motherhood. Further, we (...) suggest, both formula-feeding and breastfeeding mothers experience shame: the former report feeling that they fail to live up to ideals of womanhood and motherhood, and the latter transgress cultural expectations regarding feminine modesty. The problem, then, is the degree to which mothers are vulnerable to shame generally, regardless of infant feeding practices. As an emotion that is less adaptive and potentially more damaging than guilt, shame ought to be the focus of resistance for both feminists and breastfeeding advocates, who need to work in conjunction with women to oppose this shame by assisting them in constructing their own ideals of good motherhood that incorporate a sense of self-concern. What is called ``orthodox'' quantum mechanics, as presented in standard foundational discussions, relies on two substantive assumptions --- the projection postulate and the eigenvalue-eigenvector link --- that do not in fact play any part in practical applications of quantum mechanics. I argue for this conclusion on a number of grounds, but primarily on the grounds that the projection postulate fails correctly to account for repeated, continuous and unsharp measurements and that the eigenvalue-eigenvector link implies that virtually all interesting properties are (...) maximally indefinite pretty much always. I present an alternative way of conceptualising quantum mechanics that does a better job of representing quantum mechanics as it is actually used, and in particular that eliminates use of either the projection postulate or the eigenvalue-eigenvector link, and I reformulate the measurement problem within this new presentation of orthodoxy. Some claim that Composition as Identity (CI) entails Mereological Essentialism (ME). If this is right, then we have an effective modus tollens against CI: ME is clearly false, so CI is, too. Rather than deny the conditional, I will argue that a CI theorist should embrace ME. I endorse a theory of modal parts such that ordinary objects are spatially, temporally, and modally extended. Accepting modal parts is certainly beneficial to CI theorists, but it also provides elegant solutions to the (...) traditional puzzles of constitution, making it a competitive move in its own right. This paper argues that Plato’s Meno does not offer evidence for a belief, commonly attributed to Plato, that we when learning something recollect what we learn from previous existences. This “theory of recollection” is a construct based on a reading of the relevant passages in the Meno which does not take into account the dialectical aspect of Socrates’ discussion with his interlocutor. And in one passage (81e3) it is based on a variant reading for which a better and better attested (...) reading is available. The reference to recollection is used to make Meno agree to an absurd position. (shrink)

Investigating the theoretical and empirical relationships between transparency and trust in the context of surveillance, this volume argues that neither transparency nor trust provides a simple and self-evident path for mitigating the negative political and social consequences of state surveillance practices. Dominant in both the scholarly literature and public debate is the conviction that transparency can promote better-informed decisions, greater oversight, and restore trust damaged by the secrecy of surveillance. The contributions to this volume challenge this conventional wisdom by considering (...) how relations of trust and policies of transparency are modulated by underlying power asymmetries, socio-historical legacies, economic structures, and institutional constraints. They study trust and transparency as embedded in specific socio-political contexts to show how, under certain conditions, transparency can become a tool of social control that erodes trust, while mistrust-rather than trust-can sometimes offer the most promising approach to safeguarding rights and freedom in an age of surveillance. This paper articulates and responds to a challenge to contemporary compatibilist views of free will. Despite the popularity and appeal of compatibilist theories, many are left with lingering doubts about compatibilism. This paper explains this doubt in terms of the absurdity challenge: because a compatibilist accepts that they do not have causal access to all the actual sufficient causal sources of their own agency, the compatibilist can find their own agency absurd. By taking a cue from political philosophy, this paper (...) argues that a non-ideal construction of the problem of free will allows compatibilists to overcome this existential-metaphysical challenge, and by doing so, perhaps adopt a metaphysically progressive picture of human agency. Alan Wallace introduces a natural theory of human consciousness that has its roots in contemporary physics and Buddhism. Wallace's "special theory of ontological relativity" suggests that mental phenomena are _conditioned_ by the brain, but do not _emerge_ from it. Rather, the entire natural world of mind and matter, subjects and objects, arises from a unitary dimension of reality that is more fundamental than these (...) dualities, as proposed by Wolfgang Pauli and Carl Jung. To test his hypothesis, Wallace employs the Buddhist meditative practice of _samatha_, refining one's attention and metacognition, to create a kind of telescope to examine the space of the mind. Drawing on the work of the physicist John Wheeler, he then proposes a more general theory in which the participatory nature of reality is envisioned as a self-excited circuit. In comparing these ideas to the Buddhist theory known as the Middle Way philosophy, Wallace explores further aspects of his "general theory of ontological relativity," which can be investigated by means of _vipasyana_, or insight, meditation. Wallace then focuses on the theme of symmetry in reference to quantum cosmology and the "problem of frozen time," relating these issues to the theory and practices of the Great Perfection school of Tibetan Buddhism. He concludes with a discussion of the general theme of complementarity as it relates to science and religion. The theories of relativity and quantum mechanics were major achievements in the physical sciences, and the theory of evolution has had an equally deep impact on the life sciences. However, rigorous scientific methods do not yet exist to observe mental phenomena, and naturalism has its limits for shedding light on the workings of the mind. A pioneer of modern consciousness research, Wallace offers a practical and revolutionary method for exploring the mind that combines the keenest insights of contemporary physicists and philosophers with the time-honored meditative traditions of Buddhism. Daniel Bell and Wang Pei’s recent monograph, Just Hierarchy, seeks to defend hierarchical relationships against more egalitarian alternatives. This paper addresses their argument, offered in one chapter of the book, in favour of a hierarchical relationship between human and nonhuman animals. This relationship, Bell and Pei argue, should conform to what they call “subordination without cruelty:” it is permissible to subordinate and exploit animals for human ends, provided that we do not treat them cruelly. We focus on three aspects of (...) their view: their argument for a hierarchical view; their understanding of cruelty; and their account of the heightened duties they claim we owe to nonhuman animals who are intelligent, domesticated, and/or “cute.” We argue that the reasons that Bell and Pei offer fail to support their conclusions, and that, even if one accepts a hierarchical view, the conclusions that Bell and Pei draw about the permissibility of practices such as killing animals for food do not follow. We conclude by emphasizing philosophers’ responsibility to thoroughly test their arguments and to engage with existing debates, especially when the practices they seek to justify involve harms of great magnitude. This paper is a historical, legal and philosophical analysis of the concept of human dignity in German and Kenyan constitutional law. We base our analysis on decisions of the Federal Constitutional Court of Germany, in particular its take on life imprisonment and its 2006 decision concerning the shooting of hijacked airplanes, and on a close reading of the Constitution of Kenya. We also present a dialogue between us in which we offer some critical remarks on the concept of human dignity (...) in the two constitutions, each one of us from his own philosophical perspective. A lump theorist claims that ordinary objects are spread out across possible worlds, much like many of us think that tables are spread out across space. We are not wholly located in any one particular world, the lump theorist claims, just as we are not wholly spatially located where one’s hand is. We are modally spread out, a trans-world mereological sum of world-bound parts. We are lump sums of modal parts. And so are all other ordinary objects. In this paper, (...) I explore lump theory and investigate five arguments against it. These arguments may be the primary reasons why lump theory has not been widely accepted––or extensively explored––until now. I maintain that these arguments can be answered, and moreover, that accepting lump theory has distinct advantages, making it a competitive view in its own right. (shrink)

In 1962, the philosopher Richard Taylor used six commonly accepted presuppositions to imply that human beings have no control over the future. David Foster Wallace not only took issue with Taylor's method, which, according to him, scrambled the relations of logic, language, and the physical world, but also noted a semantic trick at the heart of Taylor's argument. _Fate, Time, and Language_ presents Wallace's brilliant critique of Taylor's work. Written long before the publication of his fiction and essays, (...) Wallace's thesis reveals his great skepticism of abstract thinking made to function as a negation of something more genuine and real. He was especially suspicious of certain paradigms of thought-the cerebral aestheticism of modernism, the clever gimmickry of postmodernism-that abandoned "the very old traditional human verities that have to do with spirituality and emotion and community." As Wallace rises to meet the challenge to free will presented by Taylor, we witness the developing perspective of this major novelist, along with his struggle to establish solid logical ground for his convictions. La humildad copernicana establece que el Universo es un lugar homogéneo en el que las leyes aplican indistintamente en cualquier lugar, es decir, no existe un centro o lugar privilegiado. En ese sentido el lugar que ocupa la Tierra en el Universo es como cualquier otro, nada especial y mucho menos relacionado al favor de un Dios omnipotente cuya creación favorita sea el ser humano. Siendo esto así, sería entonces factible pensar la existencia de muchos otros planetas que como la (...) Tierra alberguen vida y sustenten civilizaciones tan o más avanzadas como la nuestra. Sin embargo, ¿por qué aún no hemos contactado con otras civilizaciones? Esto último se conoce como la paradoja de Fermi. ¿Por qué si la Tierra es solo un punto más en el Universo parece que no hay otras Tierras y otros seres inteligentes con quienes contactar? Una posible solución que intentamos discutir en el presente texto es la Hipótesis de la Tierra Rara, según la cual, en efecto, el planeta Tierra es una cosa extraordinaria en el universo. Más allá de discutir la plausibilidad de esta hipótesis frente a otras, interesa puntualizar algunos corolarios que se siguen de la misma, y su implicación para el copernicanismo desde un punto de vista filosófico. This manuscript describes the responses and correlates of outpatients with schizophrenia spectrum disorders to a tool designed to measure comprehension before obtaining informed consent for research participation. We used the Evaluation to Sign Consent form to document comprehension in 100 outpatients as part of their consent to participate in an ongoing study of an exercise intervention. The findings suggest that using this form is a feasible and acceptable approach to documenting comprehension of research procedures prior to obtaining informed consent. Age (...) 49 years and older and the receipt of intramuscular antipsychotic medication predicted the need for additional assistance to complete the Evaluation to Sign Consent form successfully (χ2 = 8.29, P = 0.016). Nurse researchers should consider documenting comprehension with this tool owing to its availability, time efficiency and utility. (shrink)

Protecting the privacy of individually-identifiable health data and promoting the public’s health often seem at odds. Privacy advocates consistently seek to limit the acquisition, use, and disclosure of identifiable health information in governmental and private sector settings. Their concerns relate to misuses or wrongful disclosures of sensitive health data that can lead to discrimination and stigmatization against individuals. Public health practitioners, on the other hand, seek regular, ongoing access to and use of identifiable health information to accomplish important public health (...) objectives. The collection and use of identifiable health data by federal, tribal, state, and local health authorities support nearly all public health functions and goals.Identifiable health data are the lifeblood of public health practice. When aggregated, these data help authorities monitor the incidence, patterns, and trends of injury and disease in populations. Current economic conditions have coincided with the implementation of the Health Insurance Portability and Accountability Act and forced public health officials to consider how to ethically incorporate compliance into their already strained budgets, while maintaining the integrity and intent of the legislation.As of April 14, 2003, the HIPAA Privacy Rule provides a new federal floor of protections for personal health information. The Privacy Rule establishes standards for the protection of health information held by many physicians’ offices, health plans, and health (...) care clearinghouses. The Rule protects personal health information by establishing conditions regulating the use and disclosure of individually identifiable health information by these entities, also referred to as covered entities. This paper questions the conceptual and pragmatic worth of the category of relational values. Combining philosophical reasoning with ethnographic field-work in Wallmapu/Chile, I analyse a variety of ways in which people think about, value and behave toward the land. I thereby demonstrate that relational-ity is inherent to held, instrumental and intrinsic values. This means that there is no meaningful way in which to distinguish relational values from more familiar types of values. Yet, to be able to argue that a distinct (...) class of relational values exists, those who have proposed the term have been compelled to silence or downplay the relational natures of those other values. This has the perverse effect of confining, rather than promoting, relational thinking. (shrink)

The purpose of the paper is to investigate into the peculiarities of the reflection of sense as the main idea of modern European philosophy. This idea refers to self-consciousness, about which modern empirical philosophy speaks in the language of reflection (J. Locke), and rationalism - in the language of Cogito (R. Descartes). For Kant, Cogito is a transcendental condition for the formation of concepts, and therefore reflection should be transcendental. According to Husserl, the main task of phenomenological reflection was to (...) obtain essences of processes, to build things from the acts of Cogito. In Husserl's words, reflection "carries the world as a meaningful sense". Such a sense (smysl) becomes a problem escaping both from analysis and interpretation. Its peculiarity lies in the deontological status of sense: the phrase "a sense should be" connects the sense with a realm of duty, and duty provides a correlation between Ego and integrity of the world, language and culture. Reflection of sense (smysl) becomes the process of comprehension, the mechanism of formation of the whole set of meanings in the culture. (shrink)

One of the primary burdens of the mereological nihilist is accounting for our ordinary intuitions about material objects. It certainly *seems* as if I am typing on a keyboard, which has particular keys and buttons as parts. But such intuitions are mistaken if mereological nihilism is right, leading to widespread error. So nihilists often propose paraphrases of our everyday utterances as compensation. Cotnoir aims to deliver a new paraphrase strategy on behalf of the nihilist: one that interprets parthood and composition (...) modally, and interprets (spatial) parts as (modal) counterparts. He advertises this view as the spatial analog of Sider’s stage-theoretic view. Unfortunately, I argue, it isn't. The spatial analog to the above views would be something like the following: individuals are region-bound spatial bits. Certain spatial claims about these objects may be true if the relevant spatial bits have the appropriate spatial counterparts. The table is flat iff the table (a spatial bit) has a spatial counterpart that is flat. That is, spatial *counterparts* make certain spatial claims true. Call this the *bit-theoretic* view. In this paper, I use the bit-theoretic view as a foil for highlighting certain aspects of Cotnoir’s proposal, as well as to show that the very ways in which Cotnoir’s view differs from the bit-theoretic view are ways in which it undermines advantages of nihilism.
